Makati City Representative Abigail Binay was indeed lucky as she recently
won a studio-type condominium unit in Rockwell Land’s The Grove in Pasig City.
The unit, pegged at around P5 million, was raffled off by a mall in Makati, Power Plant Mall, where her Brother Jun-Jun Binay is also serving as Mayor.
Shortly after the ad that announced Binay won was posted on Rockwell Power Plant's Facebook account, several netizens disputed the validity of the raffle.
However, Civil Service Commission Chair Francisco Duque said the congresswoman did not violate any law when she joined a raffle and eventually won a condo unit.
In a phone interview with DZMM, Duque explained there are currently no laws prohibiting Binay or any public official from joining a raffle even if it was held in her own city.
“Wala namang batas na malinaw na nagsasabing bawal kayong sumali sa raffle dahil hindi tama dahil kayo'y posibleng mag-approve o [maging] approving authority sa mga project ng party o project, ang maganda gumawa tayo ng batas patungkol diyan,” Duque told DZMM.
(There is no clear law that prohibits officials from joining raffles because even though some of them might be in positions of authority that approve projects. We could propose a law that ought to address that.)
Duque also clarified that joining raffles is not considered gambling.
“Hindi naman talaga siya sugal dahil although game of chance, hindi naman talaga siya game, kasi it’s a raffle,” he noted.
(It's not really gambling although it's a game of chance. But then again, it's not really a game because it's a raffle.)
